Terms and Conditions
General terms and conditions of sale for vehicle wholesale transactions with business customers.
1. Scope
These terms apply to all sales of vehicles by [Company legal name] [Legal form (e.g. GmbH, SAS, Ltd)] ("Autovantis") to business customers within the meaning of Art. 2 of Directive 2011/83/EU (entrepreneurs, legal entities). We do not sell to consumers. Deviating terms of the buyer apply only if we have expressly agreed to them in writing.
2. Offers and conclusion of contract
Information on our website and vehicle lists is non-binding and subject to prior sale. A contract is concluded only when we confirm an order in writing (including by email) or deliver the vehicle.
3. Prices and payment
All prices are in euros and net of VAT, unless stated otherwise. For intra-community supplies, the buyer must provide a valid VAT ID and the documents required to prove the supply (e.g. confirmation of arrival). Unless agreed otherwise, the purchase price is due in full before the vehicle and its documents are handed over.
4. Collection, delivery and transfer of risk
Vehicles are sold ex works from the agreed location unless transport is agreed separately. Risk passes to the buyer upon handover to the buyer or the carrier appointed by the buyer. The buyer must collect vehicles within the agreed time; storage costs may be charged after that.
5. Retention of title
Vehicles and vehicle documents remain our property until the purchase price and all related claims have been paid in full.
6. Condition and warranty
Vehicles are sold in the condition described in the order confirmation. To the extent permitted by law, claims for defects for used vehicles are excluded, and for new vehicles limited to 12 months from handover. Obvious defects and transport damage must be reported in writing upon handover.
7. Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence, we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract.
8. Governing law and jurisdiction
The law of [Country] applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is our registered office ([Postal code and city]).
9. Final provisions
Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected. Last updated: November 2026.
